Since July 13, 2013, after § 3 paragraph 13 of the Animal Protection Act prohibited ,
an animal for his own sexual acts or train them to use third parties to sexual acts or to make available and thereby force to artwidrigem behavior.
In the public debate on this was, this law is referred to as Zoophilia-Ban .
The Zoophilia-Ban was introduced with the intent to better protect animals against sexual assault. However, sexual violence was punishable before the animal welfare amendment after §17 and §18 Animal Welfare Act.If convicted, in any event threaten fine of up to 25,000 € .
On December 8, 2015, the Federal Constitutional Court rejected a complaint against the § 3 sentence 1 No. 13 from the Animal Welfare Act. In the Reason code it made clear that anchored in the Animal Welfare Act prohibition grab only if the animal is forced to species-contrary behavior. Thus, the sex with animals is not in principle prohibited.
